I. Overarching Principle for NBGee Foundry:
NBGee Foundry champions human creativity and innovation across all artistic and technological domains. We view Artificial Intelligence as a powerful tool that can augment, inspire, and assist human creators and developers, rather than replace them. Our unwavering commitment is to fostering genuine human expression and ingenuity, ensuring absolute transparency in how AI is utilized, and upholding the highest standards of intellectual property (IP) and ethical practice.
II. The NBGee Foundry AI Transparency Labeling System:
To provide clear, consistent, and granular disclosure of AI's role in creative and technical works, NBGee Foundry will utilize the following three primary labels. This system empowers consumers, fosters trust with creators, and reflects our commitment to responsible innovation.
Label 1: HUMAN-CREATED (AI-FREE / Minimal AI Utility)
Description: This label designates content where AI generative tools created the primary creative output with minimal to no direct human creative input, direction, editing, or transformation beyond initial simple prompts. The AI is effectively the sole "author" or "creator" of the work.
NBGee Foundry Stance: NBGee Foundry will NOT commercially sell, publish, or represent content falling under this label through its record label, publishing arm, or art curation channels. This policy reflects our core commitment to human creativity, current legal ambiguities surrounding AI-only authorship, potential intellectual property infringement risks from training data, and existing platform restrictions (e.g., IngramSpark's non-acceptance of pure AI-generated literature).
Potential Internal Use: Content under this label may be used internally by NBGee Foundry for experimentation, brainstorming, or as educational examples within NBGee Technology Labs, but not for direct external commercialization or public representation.
Examples: An AI tool generates an entire song (melody, harmony, lyrics, instrumentation) from a single text prompt; a prompt like "Write a fantasy novel about a dragon" results in a complete, unedited manuscript solely from AI; an image generated by an AI tool from a simple prompt, with no subsequent human artistic modification or selection beyond downloading the first result; AI generates a complete, complex software module from a high-level prompt, and it's used directly without a human developer taking full ownership and significant modification.
III. NBGee Foundry's Stance by Vertical:
A. As a Record Label (Music):
Signing AI Artists (Purely AI-Generated Music): NBGee Records will NOT sign purely AI-generated "artists" or acts where the primary creative output is solely from an AI.
Accepting AI-Assisted Music: NBGee Records WILL accept and release music labeled AI-ASSISTED where AI tools are used as a creative assistant by a human artist, provided there is clear and substantial human creative input and oversight. Full transparency will be required.
B. As a Book Publisher (Literature):
Accepting AI-Written Books (Purely AI-Generated Literature): NBGee Publishing will NOT accept submissions or publish books labeled AI-GENERATED where the primary creative content is solely generated by AI.
Accepting AI-Assisted Literature: NBGee Publishing WILL consider and publish books labeled AI-ASSISTED where AI tools have been used by a human author, provided the human author maintains full creative control and contributes the substantial original content. Transparency is required.
C. As an Art Curator / Seller (Visual Art):
Selling AI-Generated Art (Purely AI without Human Creative Input): NBGee Foundry will NOT primarily curate or sell visual art labeled AI-GENERATED.
Selling AI-Assisted Art: NBGee Foundry WILL curate and sell visual art labeled AI-ASSISTED where AI tools have been used by a human artist as a creative instrument, provided the human artist's vision and artistic intent are central to the final piece. Transparency is expected. (This applies to DJ NBGee's album covers.)
D. NBGee Technology Labs (Open Source Code Development):
Stance: NBGee Technology Labs actively explores the use of AI as a powerful development tool (generating code, suggesting solutions, optimizing workflows).
Requirements for Open-Sourcing AI-Assisted Code:
Human Authorship & Oversight: All open-source code released, even if initially generated by AI, must undergo substantial human creative input, review, modification, and integration by a human developer, who assumes full responsibility. This code will be labeled AI-ASSISTED.
Intellectual Property (IP) Due Diligence: We employ rigorous IP compliance, including using tools to scan for potential third-party copyright violations. Only code cleared with zero flagged violations will be open-sourced.
Transparency: We commit to transparency regarding AI use in documentation (e.g., README files, code comments) and contributor guidelines.
Licensing: Open-source code will be released under standard, recognized open-source licenses (e.g., MIT, Apache 2.0) where human copyright has been clearly established.
IV. NBGee Foundry's Approach to Detecting AI Works:
We acknowledge that no single "silver bullet" tool reliably detects all AI-generated content across all modalities with 100% accuracy. Therefore, NBGee Foundry employs a multi-faceted approach:
Primary Tool: Required Transparency & Human Review: Our most critical "detection" mechanism is our policy requiring creators/developers to transparently disclose the use of AI. This places responsibility on the creator and is reinforced by thorough human review processes by our experienced team.
Secondary Tool: Human Expertise & Critical Eye: Our team will continuously develop an understanding of the evolving "tells" of AI-generated content across various media.
Tertiary Tool: Spot-Checking with Available AI Detectors: For certain submissions (e.g., text, code), we may utilize commercially available AI detection tools as an additional data point in our review process, understanding their current limitations.
IP Compliance Tools: Specifically for code, robust tools will be used to scan for existing copyrighted material within AI-generated outputs.

Description: This label designates content where AI tools played no role in the creative generation or conceptualization process. Any AI involvement is strictly limited to ubiquitous, non-creative utility functions that are indistinguishable from standard software tools (e.g., basic spell-check, grammar correction, lossless file compression, uncreative formatting, automated backups, syntax highlighting). The entire creative ideation, execution, and significant refinement are attributable solely to human effort.
NBGee Foundry Stance: This represents the highest tier of human authorship. NBGee Foundry proudly supports and prioritizes Human-Created works across all verticals.
Examples: A song entirely composed, performed, recorded, mixed, and mastered by human artists; a novel entirely written by a human author; a painting or photograph created by a human artist using traditional tools; code written by a human developer for a new algorithm.
Label 2: AI-ASSISTED (Human-Led Collaboration)
Description: This label is for content where AI generative tools (e.g., large language models, image generators, music generators, code assistants) were used as a significant creative instrument or assistant by a human creator. The human provides the creative direction, makes artistic choices, performs substantial edits, curation, selection, and/or transformation of AI outputs. The final work reflects significant human intellectual and creative input and the human takes full ownership and responsibility.
NBGee Foundry Stance: NBGee Foundry actively encourages and supports human creators who skillfully integrate AI as a powerful tool to expand their creative potential. We celebrate the synergy between human vision and AI capabilities under this label.
Requirements for Commercial Release/Publication:
Human must be the primary creative director, author, and/or developer.
Substantial human input and transformation are evident and demonstrable.
Full transparency of specific AI tool use is required for NBGee internal records and appropriate public disclosure (e.g., in metadata, liner notes, artist statements, project READMEs).
Examples: A human composer uses AI to generate melodic ideas or synth patches, then structures, arranges, performs vocals, mixes, and masters the final track; a human author uses AI to brainstorm plot points, draft initial character dialogue, or generate descriptive passages, but then heavily edits, rewrites, and integrates these into their unique narrative voice; an artist uses AI image generators to create initial concepts or textures, then performs significant post-processing, compositing, or painting over to achieve a distinct artistic vision (like DJ NBGee's album covers); a developer uses an AI code assistant to generate initial functions, then reviews, refines, tests, and integrates the code, assuming full ownership.
