Please read these Terms of Service ("Terms") carefully before using the websites, products, and services offered by NBGee Foundry, LLC, and its associated brands and websites, including but not limited to nbgeefoundry.com, nbgee.com, shop.nbgee.com, and play.nbgee.com (collectively, the "Services"). Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms.

1. Agreement to Terms

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Pre-Alpha & Developmental Access

The interactive MUD service accessible via play.nbgee.com is currently in a "Pre-Alpha" developmental state. By using this specific service, you acknowledge that:

  • Data Transience: All in-game progress, character states, and non-purchased inventory (collectively "Echoes") are transient.

  • Wipe Policy: NBGee Foundry, LLC reserves the right to reset, wipe, or modify the database at any time without notice or liability for loss of in-game progress.

  • "AS IS" Status: The developmental game environment is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

3. Use of Services & Account Linking

You may use our Services only if you can form a binding contract with NBGee Foundry, LLC, and only in compliance with these Terms and all applicable laws. Any use or access by anyone under the age of 13 is strictly prohibited.

  • Discord Integration: Accessing our Services via the Discord Gateway requires explicit authorization for NBGee Foundry to link your Discord UserID with your NBGee Shop account for the purpose of cross-platform "Phygital" synchronization. You must comply with Discord's Community Guidelines while utilizing the Gateway.

4. Physical Products & Print-on-Demand Fulfillment

Physical merchandise purchased via www.nbgeefoundry.com is created using a print-on-demand model to reduce overproduction.

  • Merchandise: Apparel, mugs, and accessories are fulfilled and shipped by our third-party partner, Printful.com.

  • Paperback Books: Books are printed and fulfilled by our third-party partner, Lulu.com.

By placing an order for a physical item, you acknowledge that manufacturing and shipping times are estimates and subject to our partners' processing queues. All physical merchandise is subject to our separate Shipping Policy and Returns and Refund Policy.

5. Affiliate Links & Third-Party Services

Certain pages on our website, specifically including "The Foundry Tech Stack", contain affiliate links. Clicking on these links and making a purchase may earn NBGee Foundry, LLC a commission at no additional cost to you. We are not responsible for the content, privacy policies, or practices of any third-party websites. Please refer to our Affiliate Disclosure for more information.

6. Your Content & Intellectual Property

You retain full ownership of your files and content you submit to the Services ("Your Content"), granting us the limited rights needed to run the Services. We respect the intellectual property of others. The "NBGee Foundry" name, logo, and proprietary game blueprints are the exclusive property of NBGee Foundry, LLC.

7. Limitation of Liability & Controlling Law

TO THE FULLEST EXTENT PERMITTED BY LAW, NBGEE FOUNDRY, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES. THE SERVICES ARE PROVIDED "AS IS." These Terms will be governed by Oregon law. Contact us at inquiries@nbgeefoundry.com.
