End User License Agreement (EULA) – NBGee Galactic Expeditions

This End User License Agreement ("EULA") is a binding legal agreement between you ("Player," "You") and NBGee Foundry, LLC ("NBGee," "We," "Us") governing your access to and use of the NBGee Galactic Expeditions interactive environment, including its Discord integration, web terminal, and associated software (collectively, the "Game").

BY CLICKING "I ACCEPT," AUTHENTICATING VIA DISCORD, OR OTHERWISE ACCESSING THE GAME, YOU AGREE TO BE BOUND BY THIS EULA, OUR GENERAL TERMS OF SERVICE, AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MAY NOT ACCESS THE GAME.

1. Developmental Access & Pre-Alpha Status

You acknowledge that Galactic Expeditions is currently operating in a "Pre-Alpha" developmental phase.

  • Data Transience: The Game is subject to instability, bugs, and server resets. All in-game progress, character locations, and non-protected inventory items ("Echoes") are transient.

  • Permadeath Mechanics: The Game utilizes a "Permadeath" system. Upon your character's death, your progress and standard inventory will be permanently wiped.

  • Wipe Policy: We reserve the right to reset, modify, or permanently delete the Game’s database at any time without notice or liability.

2. Phygital Data Consent & Account Linking

To provide the intended cross-platform experience, the Game integrates with Discord and the NBGee Foundry Shop.

  • By accepting this EULA, you explicitly consent to linking your Discord UserID with your NBGee Shop purchasing history and profile data.

  • You authorize our AI characters and systems to access this linked data to provide dynamic, personalized in-game interactions and to fulfill physical item extractions.

  • You may revoke this access at any time by unlinking your account, which will result in the loss of access to the Game.

3. In-Game Economy, Digital Goods, & Service SKUs

The Game allows for the purchase of digital items and survival advantages (e.g., "Emergency Oxygen Scrubs") via the NBGee Foundry storefront.

  • Protected Inventory: Digital goods purchased with real-world currency are classified as "Protected Inventory" and will survive standard in-game character death wipes until they are explicitly consumed or activated by the Player.

  • No Cash Value: Virtual items, currency, and digital goods have no real-world monetary value and cannot be exchanged for cash.

  • All Sales Final: Upon consumption, activation, or successful delivery to your Protected Inventory, all sales of digital Service SKUs are final and non-refundable, as outlined in our Terms of Sale for Digital Products.

4. Physical Extractions & Sweepstakes Compliance

The Game features a "Loot Table" that may occasionally drop digital coupons redeemable for real-world physical merchandise (e.g., apparel, books, accessories).

  • No Purchase Necessary: Purchasing digital Service SKUs is not required to find or extract physical merchandise. A free Alternative Method of Entry (AMOE) is available as detailed in our Official Rules for Galactic Expeditions.

  • Fulfillment: Extracted physical rewards are fulfilled via our third-party partners (including Printful.com and Lulu.com) and are subject to availability, geographical shipping restrictions, and our standard Shipping Policy.

5. AI-Assisted Narrative & Conduct

Galactic Expeditions utilizes advanced Artificial Intelligence (including Google Gemini models) as a Natural Language Interface (NLI) to act as the Game's parser and to narrate non-player characters (NPCs), such as the "Stowaway Octopus."

  • AI Output: You acknowledge that the NPC dialogue and environmental descriptions are AI-generated in real-time based on human-authored parameters. We do not guarantee the accuracy, appropriateness, or predictability of the AI's output.

  • Code of Conduct: You agree not to use the NLI to generate harmful, discriminatory, illegal, or harassing content. You must comply with Discord's Community Guidelines at all times while utilizing the Discord Gateway.

  • Prohibited Actions: You may not use automated scripts, bots, scrapers, or exploits to manipulate the Game's economy, server telemetry, or real-time clock mechanics. Violation of this clause will result in immediate termination of your account and forfeiture of all inventory.

6. License Grant

Subject to your compliance with this EULA, NBGee Foundry, LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and play the Game for your personal, non-commercial entertainment. You may not reverse engineer, decompile, distribute, or create derivative works based on the Game or its underlying code (the "NBGee Mainframe").

7. Disclaimer of Warranties & Limitation of Liability

THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NBGEE FOUNDRY, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE GAME, INCLUDING BUT NOT LIMITED TO THE LOSS OF DIGITAL OR PHYSICAL INVENTORY DUE TO BUGS, HACKS, OR SERVER RESETS.

8. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles.
