End User License Agreement (EULA) – NBGee Galactic Expeditions

This End User License Agreement ("EULA") is a binding legal agreement between you ("Cadet," "Player," "You") and NBGee Foundry, LLC ("NBGee," "We," "Us") governing your access to and use of the NBGee Galactic Expeditions interactive environment, including its Discord integration, web terminal, and associated software (collectively, the "Game" or "Mainframe").

BY CLICKING "I ACCEPT," AUTHENTICATING VIA DISCORD, OR OTHERWISE ACCESSING THE GAME, YOU AGREE TO BE BOUND BY THIS EULA, OUR GENERAL TERMS OF SERVICE, AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MAY NOT ACCESS THE GAME.

1. Age Requirement & AI Compliance

  • You must be at least 18 years of age to access or use the Game.

  • By accessing the Game, you represent and warrant that you are 18 years of age or older.

  • The Game utilizes third-party Artificial Intelligence interfaces (including Google Gemini) that strictly prohibit use by, or direction toward, individuals under the age of 18.

  • If you are under 18 years of age, you may not access the Game under any circumstances.

2. Developmental Access, Hazards, & Vandalism

  • Pre-Alpha Status: You acknowledge the Game is in a "Pre-Alpha" phase and subject to instability, bugs, and server resets.

  • Data Transience: All in-game progress, character locations, and non-protected inventory items ("Echoes") are transient.

  • Permadeath Mechanics: The Game utilizes a "Permadeath" system; upon character death, progress and standard inventory are permanently wiped.

  • Vandalism Protocol: Players may bypass certain corporate fees through the destruction of digital assets (e.g., using a Fusion Torch on a vending machine). Such actions result in the permanent loss of the tool used, and You acknowledge this does not entitle You to a refund or salvage value.

  • Wipe Policy: We reserve the right to reset, modify, or permanently delete the Game’s database at any time without notice or liability.

3. Phygital Data Consent, Linking, & Recruitment

  • Account Linking: To provide a cross-platform experience, the Game integrates with Discord and the NBGee Foundry Shop.

  • Consent: You explicitly consent to linking your Discord UserID with your NBGee Shop purchasing history and profile data.

  • AI Access: You authorize our AI characters and systems to access this linked data for dynamic interactions and physical item extractions.

  • Bounty Hunter Program: Recruitment via the share comms command is an incentivized activity. You agree to include the mandatory FTC disclosure provided by the Mainframe in all such transmissions.

  • Revocation: You may revoke access by unlinking your account, resulting in loss of Game access.

4. Economy, Foundry Scrip, & Service SKUs

  • Digital Goods: You may purchase digital items and survival advantages (e.g., "Emergency Oxygen Scrubs") via the NBGee Foundry storefront.

  • Protected Inventory: Goods purchased with real-world currency are "Protected Inventory" and survive standard character death until consumed or activated.

  • Foundry Scrip: The Game utilizes a non-transferable corporate utility known as Foundry Scrip. It has no real-world monetary value and cannot be exchanged for cash.

  • Ranking Logic: Global Leaderboard standing is a deterministic calculation: $(Artifacts \times 10^6) + Foundry\_Scrip$.

  • Compliance & Insubordination Taxes: Use of prohibited "magic words" (Spiritual Bankruptcy) results in a hardcoded fine of 10.00 Foundry Scrip. Additionally, any attempt to bypass Immutable Causality (e.g., attempting to utilize unauthorized /undo, /redo, or /back commands) is classified as Technical Insubordination and results in an immediate "Insubordination Tax" of 5.00 Foundry Scrip per attempt.

  • All Sales Final: All sales of digital Service SKUs are final and non-refundable upon delivery to Protected Inventory.

5. Physical Extractions & Data Decay

  • Loot Table: The Game may drop digital coupons redeemable for real-world physical merchandise.

  • No Purchase Necessary: Purchasing digital goods is not required to find or extract merchandise; a free Alternative Method of Entry (AMOE) is available.

  • Data Decay ("Bit-rot"): Extracted physical loot codes are subject to Data Decay and must be redeemed at the NBGee Foundry Shop within 48 hours or they will expire.

  • Fulfillment: Physical rewards are fulfilled via third-party partners (e.g., Printful, Lulu) and are subject to availability and our Shipping Policy.

6. AI-Assisted Narrative & Nexus of Authorship

  • NLI Parser: The Game utilizes AI (including Google Gemini) as a Natural Language Interface to act as a parser and narrate NPCs like the "Stowaway Octopus".

  • Human Authorship: To ensure IP protection, all physics, lore, and outcomes are governed by human-authored JSON blueprints. The AI acts strictly as an evaluative narrator against these human-defined rules.

  • Output Disclaimer: We do not guarantee the accuracy, appropriateness, or predictability of AI-generated dialogue.

7. Conduct & Security Hardening

  • Code of Conduct: You agree not to use the NLI to generate harmful, discriminatory, or harassing content.

  • Anti-Bot Protocol: You may not use automated scripts, bots, scrapers, or exploits to manipulate the economy or telemetry.

  • Rate Limiting: The Mainframe utilizes the v0.4.3 Fortress Stable suite; attempting to bypass API request throttling is a violation of this EULA.

  • Enforcement: Violation of security clauses results in immediate account termination and forfeiture of all inventory. We reserve the right to manually purge any bio-signature associated with automated API abuse.

8. License Grant

  • Subject to compliance, NBGee Foundry, LLC grants You a limited, non-exclusive, non-transferable, revocable license to play the Game for personal, non-commercial entertainment.

  • You may not reverse engineer, decompile, or create derivative works based on the NBGee Mainframe.

9. Disclaimer of Warranties & Limitation of Liability

  • AS IS: THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE".

  • Warranties: NBGEE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

  • Liability Cap: WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF INVENTORY DUE TO BUGS, HACKS, OR SERVER RESETS.

10. Governing Law

  • This EULA is governed by the laws of the State of Oregon, with exclusive venue in the courts of Multnomah County (Santa Clara County for Google-related merchant disputes).

11. Vessel Designation & Actuarial Protocols:

  • The Actuarial Void: You acknowledge that the primary setting of the NBGee Galactic Expedition is the derelict vessel designated "The Actuarial Void." This name is a proprietary trademark of NBGee Foundry, LLC.

  • Deterministic Actuarial Simulation: The Mainframe is a "Hardcore" survival simulation governed by deterministic actuarial logic. Your character’s survival is a calculation of environmental hazards, resource management, and compliance.

  • Immutable Causality: You acknowledge that the simulation operates on a one-way temporal axis. There are no safety nets, "undos," or checkpoints. Any attempt to reverse time is a narrative and technical violation of this EULA.

  • Delusion Index: The Game tracks "Cognitive Divergence" (the expectation of non-diegetic safety features) via a Delusion Index. High index scores result in escalating narrative hostility from the NLI and may lead to permanent character termination without refund.
